Kaufman's apprentice gets boost for Clerk

I speculated previously about two people working for Beverly Kaufman who might be line up to run for her position in 2010 but Miya Shay found the true teacher's pet:

When (Kaufman) announced her retirement, I assumed there would be a jockeying of candidates from both Democrats and Republicans. On the Dem side, several names have been bantered about, including Sue Schechter. On the Republican side, while there have been talk of several semi-notables, the main guy is shaping up to be Kevin Mauzy. Who is he? Mauzy has been Kaufman's chief deputy for years, and Kaufman quickly endorsed him as HER choice.

As previously blogged, I spent many late election evenings in the Harris County Clerk's ballot cave over the past couple of years, and not only did I never meet Mauzy, I never even heard of him before this. But let's allow Miya to continue ...

Yesterday, while covering Prof. Barton Smith's bi-annual chat about the Houston economy, I ran into Kaufman and Mauzy at the luncheon.

"Are you trying to get Mauzy in front of the TV cameras so he'll have an advantage?" I asked.

"Isn't it obvious what I'm trying to do?" Kaufman answered with a big grin. "It's called earned media, it's very important."

We chatted a bit more about Kaufman's plan. Basically, during the run-up to the November election, she tried to hand over every on camera media request to Mauzy. she (sic) plans to continue doing that as we get closer to the December run-off. The idea is to give Mauzy free TV exposure, and valuable name ID. In addition, since most of the questions asked by the media are mundane, uncontroversial clerk stuff, it's easy to sound like you know what's going on.

Basically, Kaufman's trying to give Mauzy the "air of incumbency" without being an incumbent or an elected official. This is not illegal, and it just might work. Think about every media outlet that will need an interview or a quote about voter turnout or polling hours between now and next March. If Mauzy's the one giving the information, then that's an advantage his opponents can't buy. It will help stave off Republican contenders, and force Democratic challengers into an even more uphill battle.

Let's pause for a moment here.

The Harris County Clerk, the person responsible for administering elections in the nation's third most populous county, is -- once again -- using her office to influence voter opinion to her choice, this time for the person who would succeed her. And Shay, a hard-working member of the ABC affiliate in Houston covering the political beat, is favorably impressed by this?

If you wanted an example of political corruption enabled by a compliant corporate media, you would be hard-pressed to find a better one.

Read the comments and you'll note that a GOP precinct chair isn't too fond of the idea, either. Then again Mr. Large has been in the news over his, ah, issues with other Republican candidates also.

Clerk Kaufman retiring

Harris County Clerk Beverly Kaufman, a one-time Waller County farm girl who oversaw record-keeping and election functions of the nation's third largest county, announced Friday she will not seek a fifth term next year. ...

n 1994, Kaufman was appointed to fill an unexpired term as county clerk after the death of Molly Pryor, who had been appointed eight months earlier after the death of longtime clerk Anita Rodeheaver.

Duties of the county clerk include maintaining records for commissioners court, probate and civil courts; overseeing records of real property, tax liens and vital statistics, and supervising elections.

Congratulations and enjoy your retirement, Ms. Kaufman.

Let the speculation begin on her 2010 potential successors. Councilwoman and Vice Mayor Pro Tem (and DNC member) Sue Lovell is widely rumored to be interested in the post, though we likely won't hear anything about it from her until after the November municipal elections. Hector de Leon, Kaufman's director of communications and voter outreach, could have an interest; 2006 Clerk candidate and 2008 judicial candidate James Goodwille Pierre may as well.

Republicans will line up to replace Kaufman, too. Their ranks could include former and very temporary District Clerk, Theresa Chang; the man she replaced when he unsuccessfully challenged County Judge Ed Emmett, Charles Bacarisse; and Tom Moon, whose long record of both Republican activism and government service includes a stint working for both Kaufman and former tax assessor/collector Paul Bettencourt.

Dwayne Bohac and Ed Johnson probably have ruined their chances.

An elections administrator for Harris County (?)

Harris County should consider appointing a bureaucrat to take over election duties from two elected officials who currently split the job, County Judge Ed Emmett said.

Emmett said he plans to ask Commissioners Court next month or in July to authorize a study of the costs and consequences of such a change.

Harris County's tax assessor-collector registers voters, a job that accompanied its duty to collect poll taxes. The county clerk runs elections. Both are elected.

Thus, taking voter registration out of the tax assessor/collector's office and elections management out of the county clerk's office and combining them into an elections administration department, under the supervision of an appointed county official, is the idea. And I like it.

Proponents of an elections czar say an appointee would be insulated from accusations and lawsuits alleging partisanship in carrying out the duties of the office.

In late 2008, the state Democratic Party said in a lawsuit that then-Tax Assessor Paul Bettencourt, a Republican, had illegally blocked thousands of people from registering to vote. The lawsuit was settled last fall. Bettencourt resigned in December 2008 to work in the private sector, just weeks after being elected to a third four-year term.

“The Democrats' lawsuit against the tax office and Paul Bettencourt's abrupt departure were game changers,” Emmett said. “It brought to everybody's attention that any time you have partisan offices running elections, you're just sort of leaving yourself open to lawsuits.”

The legacy of Quittencourt. He now runs a company that negotiates with the Harris County Appraisal District to get property taxes lowered for homeowners, marking time for his next electoral opportunity.  Continuing with Chris Moran at the Chron ...

There was talk of tinkering with the county's elections machinery at the time. County Clerk Beverly Kaufman and newly appointed Tax Assessor-Collector Leo Vasquez opposed it. No formal proposal emerged.

“I was glad because I didn't want to lose a lot of my people,” Kaufman said.

But Kaufman is retiring, and her endorsed successor lost the March primary election for the nomination to succeed her. Vasquez lost his Republican primary.

That opens a window for proponents in which they can largely avoid the turf war over taking money, people and power from the tax assessor and clerk. Kaufman herself restarted talk of an administrator when she sent Emmett information about it a month ago. Now that she is leaving office she supports an elections administrator, she said.

“This is the ideal time, when you're not pulling the rug out from somebody that's already doing it,” she said.

No incumbent owns any turf to lose, but the challengers bidding to replace them are howling:

Democrat Ann Harris Bennett and Republican Stan Stanart, the November candidates to succeed Kaufman, both said they oppose an elections administrator.

“The voters don't have any way of removing (an appointee) when they're not happy with the performance,” Stanart said.

Democratic tax-assessor candidate Diane Trautman agreed with Stanart, though her released statement had a more partisan bent.

“Now that his hand-picked appointee for tax assessor and Beverly Kaufman's chosen successor for county clerk have been rejected by voters, Ed Emmett wants to change the rules,” Trautman said. “He wants to make sure that the next time he appoints someone to oversee elections processes in Harris County, that person cannot be removed by the voters.”

Republican tax-assessor candidate Don Sumners said, “It's not broken. We don't need to fix it.” He said he suspects the plan is retaliation for his past public criticism of Commissioners Court.

The partisan PDiddie would love for this crucial bit of democracy to fall under the control of Diane Trautman and Ann Harris Bennett. But the (perhaps utopian) idea of a non-partisan, unelected official has great appeal -- assuming it could actually happen.

Statewide, an administrator is used in 77 of the 254 counties, including Bexar, Dallas, El Paso and Tarrant. By state law, an election commission consisting of the county judge, the tax assessor, the county clerk and the heads of the local political parties hires and fires an elections administrator.

The leaders of the county's Republican and Democratic parties condemned the idea.

GOP Chairman Jared Woodfill said the party took a stand against an administrator two years ago. “It's another level of bureaucracy that we didn't need,” Woodfill said.

Democratic Chairman Gerry Birnberg said there is no party position on the matter but that he may take it up if the idea gets traction at Commissioners Court.

Charles Kuffner has more, including these questions:

Does this person have to be periodically re-appointed, or re-confirmed? Under what conditions can he or she be fired? How can you isolate this person from political pressure, yet ensure they are accountable?

All important considerations. I think my condition would be someone with prior metro county experience outside of Texas -- thus somewhat removed from the Republican Party of Texas' unique view on what constitutes free and fair elections. Yeah, I'm looking at you, Greg Abbott. Update: ... and so is Kuffner.

Tuesday's Bettencourt Follies

This promises to be the holiday gift that keeps on giving. First, the Texas Democratic Party will have a press conference tomorrow morning to announce the next step in their legal action against Paul Quittencourt:

Bettencourt's announcement that he would resign came suspiciously the day after additional legal activity was undertaken by the Texas Democratic Party—action which could shed light on misdeeds that have occurred within Bettencourt's office for years. It appears Paul Bettencourt is hoping that he can sneak off behind a late-night resignation announcement and the problems facing his office will simply go away. But that is not the case.

“The TDP will continue its efforts to bring accountability and transparency to the Harris County voter registration process. And Paul Bettencourt will have to take responsibility for any wrongdoing that has occurred within his office,” said TDP attorney Chad Dunn.

Wednesday December 10, at 10:30 a.m., at 1300 McGowen in Midtown. I'm going to try like hell to be there.

And Liz Peterson has a couple of interesting developments to report:

The Harris County Administration Building is still abuzz with rumors over who'll get picked to replace Tax Assessor-Collector Paul Bettencourt.

The most intriguing scenario mentioned so far involves the possible nomination of Commissioner Sylvia Garcia, who would give up her seat to position herself to challenge County Judge Ed Emmett in 2010 or to run for a statewide office.

Picking Garcia would give a Democrat control of the voter registration process, something that party has got to want. But Emmett would get to pick her replacement, likely giving the GOP a fourth seat at the table.

Garcia said the rumor is "absolutely not true."


Color me skeptical as well. But this is definitely more intriguing ...


The new Republican supermajority could just move the voter registration duties from the tax office to the County Clerk's office, headed by Republican Beverly Kaufman.

That idea, apart from any Garcia chatter, is already being circulated by Jim Harding, a Republican who chairs the county's bipartisan ballot board.

Last month, he blamed faulty work by Bettencourt's staff for delaying the counting process. Harding's comments triggered a bit of a brouhaha after Bettencourt left an emotional message on his answering machine.

In an e-mail to Commissioner Jerry Eversole, Kaufman and leaders of the Harris County Republican Party, Harding said such a move would "streamline all of the voter activity from initial registration to final certification of an election under County Clerk leadership."


This shift of responsibility seems to me to be distinctly possible, given the controversy of Bettencourt's tenure as voter registrar, the steadier reputation of Kaufman, and more significantly the rumors of her retirement before 2010, when the election of County Clerk is scheduled to appear on the ballot. I doubt Ms. Kaufman is anxious to take on the management of this rather large task at the end of her career. Furthermore, Councilwoman Sue Lovell is strongly rumored to be interested in the job, with Kaufman in the race or not (Kuffner notes Lovell has a few unfriendlies).

Harris commissioners OK $13 MM for more e-Slates... and paper ballots *updated*

I was unable to be present, so this post pieces together some eyewitness as well as media accounts of this afternoon's emergency gathering of county commissioners to address concerns surrounding the November election in the wake of last week's warehouse fire which destroyed all of the county's voting machines.

The $13.6 million approved will cover 2,325 voting machines and support equipment, and Beverly Kaufman indicates she has offers of "fifty here and a hundred there" from other elections administrators around the state, but not nearly enough to replace what was lost in last Friday's inferno. So while she pledges to "protect everyone's rights" by not consolidating precinct locations, she will also have 1.4 million paper ballots on hand "as a backup".

KPRC's Mary Benton, in this video report, holds a copy of a sample paper ballot. The two-page ballots will be available to "anyone who asks" for one, according to Benton.

Texas Watchdog's Twitter feed from this afternoon's meeting is here, yet Lee Ann O'Neal's report makes no mention at all of paper ballots.

State representative Garnet Coleman was present and publicly underscored concerns about voter suppression simply by virtue of fewer locations, fewer machines, and longer lines. Kaufman's pledge, as mentioned in the first graf, is to satisfy all those concerns.

I'll update this post with more as it comes around.

HARRIS COUNTY DEMOCRATIC LEGISLATORS CALL FOR DOJ TO REVIEW PLANS FOR ELECTIONS POST-VOTING MACHINE FIRE

Consolidating voting places, long lines and other other measures could reduce minority participation, they say

Sixteen Democratic lawmakers today signed a letter to U.S. Attorney General Eric Holder calling on the Department of Justice to "assist and oversee the development of new plans for conducting the upcoming elcections (sic) in Harris County."

They continue, "While we are heartened by the stated intention of local officials in Harris county and across the state to condut (sic) a fair and open election in November, we are concernece (sic) that some of the options for conducting the election could have an adver (sic) impact on voter participation...."

The lawmakers note, "...In recent elections, there have been controversial actions on the part of the Harris county officials that administer and oversee voter registrations and elections."

For all those who pine nostalgically for cardboard privacy boxes and paper voting ballots, oh boy is this the year for you.

At an emergency meeting of the Harris County Commissioners' Court on Monday, County Clerk Beverly Kaufman said paper ballots will be used to help compensate for the 10,000 pieces of electronic voting equipment that went up in flames last week.

The paper ballots will be the same as the ones regularly used by mail-in voters, and will be two-pages long for the November 2 election. Kaufman is urging residents to vote by mail and use the early voting period, which begins October 18.

Huffman violates campaign law with rally at poll

Posted about half an hour ago. Paul Bettencourt probably told her it was OK:

Joan Huffman's campaign for state Senate appears to have broken the law against campaigning on property where voting is taking place, Harris County Clerk Beverly Kaufman said today.

Republican Huffman, opposing Democrat Chris Bell in next Tuesday's state Senate District 17 runoff, hosted a barbecue luncheon for voters today inside the Tracey Gee Community Center in far west Houston. Early voting in the state Senate election is taking place through Friday in another room in the same building.

Commissioner Steve Radack, a Republican, said he attended the luncheon along with Huffman and urged people to vote for her. She is a former felony court judge.

Under state law, it is a Class C misdemeanor, punishable by a fine of up to $500, to campaign for or against a candidate "within 100 feet of an outside door through which a voter may enter the building in which a polling place is located."

Radack said a member of Kaufman's staff working at the early voting station took no action after checking into a complaint by a voter. But Kaufman said the event was "ill-advised" and should not have taken place there, regardless of the distance between the two rooms inside the community building.

Kaufman said it was up to a voter to pursue any charges against the campaign. The voter who complained to the election worker said she, indeed, would do so.


Just another reason to go vote for Chris Bell (as if you need one).

Taking "vote twice" too seriously

A sample of sources on the announcement that over 1100 Harris County residents voted twice. Literally:

Harris County Clerk Beverly Kaufman told reporters this morning that as many as 1,147 people voted twice in the primary earlier this month. Of course, if voters do that "knowingly," they can be prosecuted, and Kaufman is sending a list of names to the Harris County District Attorney's Office.

Some of them, she says, voted in both the Democratic and Republican primaries. Others, she says, voted twice in the same primary.

And more from the Chron:

The list included two groups: 759 voters like Duran who appear to have voted in both the Democratic and Republican primaries. An additional 389 people appear to have voted during the early voting period, and again on election day.

The intense campaigning in Texas, with slogans telling people to "vote twice" or do the "Texas two-step" may have confused people, Kaufman said.


Two interpretations of the facts. First, Mrs Kaufman: “I’m convinced that there are some instances where people had strong feeling on both sides of the aisle where they wanted to vote for a candidate on both ballots thinking they wouldn’t get caught.”

And Gerry Birnberg, the Harris County Democratic Party chair: “Those people who actually voted in the Republican primary and then tried to mess with Democratic primary committed crimes, and they should be prosecuted.”

Recall that I wrote earlier about speaking with someone who is probably on the list at the DA's office.

More to the point: which group of voters do you suspect would have been motivated to vote in both the Democratic and Republican primaries? Let's see, wasn't it Rush Limbloat who urged his sheep to cross over and vote for Hillary in the Democratic primary? Surely Rush's Houston following wouldn't be so eager to follow their leader as to break the law, would they?

Maybe they thought: since this is Texas, only the "Democrat party" would be investigated for "vote fraud."

Harris County elections warehouse burns *updates*

It's where the voting machines are stored.


Firefighters are battling a three-alarm blaze at a northeast Houston warehouse that stores the majority of voting equipment in Houston and Harris County, according to HFD.

The Harris County Election Technologies Center, located on Canino at Downey, caught fire around 4:20 this morning, quickly growing to three-alarms.

The warehouse stores more than 10,000 pieces of equipment including voting booths and E-slates, which are used in the election process.

This comes before the general elections to be held November 2, which includes Governor’s race. Early voting is scheduled to begin in October.

Beverly Kaufman probably wishes she had retired a few months ago. Now she has a fairly huge challenge. Depending on the scope of the damage, of course (which I'm certain is still being assessed as I post this) she must choose -- and then train poll workers and then implement -- a partial or entirely new voting method for the second-largest county in the nation. All in about seven or eight weeks' time. Projected voter turnout somewhere around four million hundred thousand, give or take a million hundred thousand (sorry, one too many zeros).

Is there sufficient equipment stored elsewhere in the state by Hart InterCivic that can be shipped to arrive here in time? If not, then what alternate system will be used?

You can almost hear the shrieking now of "voter fraud" from both camps, can't you? Then there will naturally be the lawsuits, some before and more after the fact.

Together with the Vasquez vs. Houston Votes undercard, we are guaranteed a barnburner (*groan*) of an election cycle in Harris County, and that's before we mention a single race.

Lunchtime update: all 10,000 e-Slates and accompanying MBBs were destroyed. There's a press conference scheduled this afternoon where Kaufman will announce a plan going forward, which seems at this point to consist of borrowing machines from neighboring counties. There isn't anything close to 10,000 DREs on standby in the entire state; I'd be surprised if she can collect 1,000 from Harris County's next-door neighbors. So rather than try to get something in on short notice to replace the former system, Kaufman apparently wants to keep the current protocol in place, which does have the value of minimizing errors, opportunities for mischief, and liability on her part. I predict she will underscore the importance of early voting and patience. Early conclusion: we'll have considerably fewer machines to vote with, and much longer lines to stand in to vote.

"Because I don’t expect to have 10,000 pieces to work with, no matter what we do, I’m sure that we’re going to be putting on a full court press urging people to vote early," Kaufman said.

Then this from Brad Friedman ...

A source familiar with Hart Intercivic tells The BRAD BLOG that the nation's fourth-largest e-voting company has fallen on hard times of late and does not have machines to ship to replace those lost in the fire.

If they can't get "similar machines" from somewhere, how, oh, how will the citizens of Houston be able to have elections this year?! Especially since pieces of paper, pens, eyeballs, citizen oversight and common frickin' sense were all long ago outlawed in Harris County, Texas, apparently.

Early vote doubles in Harris County (and predicted outcomes)

With early voting coming to end this evening, more Houstonians are casting their ballots before next week's primary than in 2006, the last time Texans went to the polls to choose a governor.

According to daily early-voting updates compiled by Harris County Clerk Beverly Kaufman, a total of 55,960 had voted through midafternoon Thursday.

“It will easily double our turnout in early voting as of four years ago,” said Kevin Mauzy, chief deputy in the Harris County clerk's office. In 2006, the total number of early voters through Thursday afternoon was 33,362.

A total of 36,321 Republicans voted through Thursday. That number compares with 18,803 through the same period four years ago. On the Democratic side through Thursday, 23,914 voted early, compared with 6,454 in 2006.

My predictions for next Tuesday: Bill White gets the 60% Dr. Murray said he would; Governor AMF in a run-off with Kay Bailey; Hank Gilbert defeats Kinky Friedman in the race for commissioner of agriculture. Hector Uribe easily bests Bill Burton for commissioner of the general land office.

I can't predict the lieutenant governor contest between Linda Chavez-Thompson and Ronnie Earle, but Marc Katz might just get enough to force a run-off between them. Thompson has the surname advantage that usually sweeps a Democrat to victory in places like the Valley, but Earle's name recognition and perception of competence for the state's highest elected legislative job is formidable. I'll SWAG that Thompson finishes slightly ahead of Earle, run-off or no.

Sheila Jackson Lee comes in first against her two challengers in CD-18, but they hold her under 50% and she goes to a run-off with councilman Jarvis Johnson. Borris Miles edges Al Edwards in HD-146. And Sue Schechter just ahead of Ann Bennett for Harris County Clerk.  Here's a good story Chris Moran at the Chron did about the two women as well as the two Republicans running to replace Beverly Kaufman. Kevin Mauzy, quoted in the excerpt above, is one of them and is piling up his earned media, just as Kaufman promised.  Besides being the Chosen One, Mauzy seems competent and experienced and is running against an extreme party hack named Stan Stanart ...

Long a GOP activist, Stanart said he wants to give the public more confidence in the security and integrity of its elections. He suggested that not all voters are being asked for identification and that elections need protection from the activist group ACORN, which has been plagued by accusations of voter fraud. Stanart did not offer any instances of specific Harris County breaches, though. Stanart is also the former executive director of Citizens Lowering Our Unfair Taxes.

Locke's "black/brown coalition" turns red

Gene Locke, the African-American faux Democrat in the Houston mayoral tilt -- to be distinguished from the Anglo faux Dem Peter Brown -- has the full and unqualified support of the Republican elections administrator in Harris County, Beverly Kaufman.

Muse:

This is the same Beverly Kaufman who is on record as being against the pre-clearance portion of the Voting Rights Act. Pre-clearance is in place for nine Southern states that have a history of discrimination or suppressing minority voting, including Texas. ... What am I missing? How does having Beverly Kaufman on your team not drive away Democrats, especially minorities?

Neil:

Mr. Locke assumes black voters in Houston will support him for Mayor because he is black—But black support may not be enough to reach a runoff. To get the extra votes he feels he needs, Mr. Locke will engage in low-down tactics

He’ll sell out his core supporters in a heartbeat.

Mr. Locke thinks black folks in Houston are stupid. He thinks he can trumpet the support of people who don’t at all share the beliefs of his most important voters, and that people won’t catch on that he is a fraud.

Locke and Brown remind me of a couple of aluminum siding salesmen working both sides of the street; one goes into the rube's living room thirty minutes after the other promising them a set of eight steak knives instead of six.

How many people are going to fall for their act? Probably enough to get one of these scam artists into the runoff.

e-voting woes: Hart InterCivic's e-Slates

A recent study of the electronic voting machine used in Harris County found that attacks on the system could compromise the accuracy, secrecy and availability of the machine.

The California secretary of state's office conducted a "top-to-bottom review" of the voting machines certified for use in California, including the Hart InterCivic system used here.

The tests, administered by the University of California at Davis, found that absent tighter procedures, hackers could alter vote totals, violate the privacy of individual voters and delete audit trails.


Debra Bowen, the CA SOS, decertified the Hart machines (.pdf) for use in her state. She tentatively will re-approve them if they use an updated, more secure version of their (still-proprietary) software.

The Harris County Democratic Party's Elections Integrity Working Group, an offshoot of the Progressive Populist Caucus' efforts to thwart the assortment of voter suppression tactics throughout the largest county in Texas, will meet today with Houston mayor Bill White, Harris County clerk Beverley Kaufman and others to discuss the issues swirling around Hart's e-Slates.

Kaufman's office doesn't think the California hackfest is anything to worry about:

"The laboratory experiment, as conducted by the UC-Davis researchers, seems almost impossible to replicate outside that laboratory environment. Thus, voters in Harris County should be aware, but not be concerned by the results," said Hector DeLeon, a spokesman for Harris County Clerk Beverly Kaufman, whose office administers elections.

DeLeon called the test unrealistic because it is "premised on providing unfettered access to the voting equipment to a malicious individual with the technological savvy and ingenuity to violate the system."

"Relying on security through obscurity is a terrible thing to do," UC-Davis computer science professor Matt) Bishop said. "(Hackers) can get the info, the only question is how hard do they have to work to get it. Any defense that relies on ignorance underestimates how ingenious attackers can be and overestimates how fallible people are."


The county, under contract, conducts all of the city of Houston's municipal elections. Harris County officials from top to bottom are Republicans; Houston's mayor and a predominant majority of city council members are Democratic.

The possibility of having paper trails -- much less a paper ballot -- in time for the November 2008 election is slim and none, and Slim just rode out of town. The city is disinclined from a cost aspect to add printers to the e-Slates; the county genuinely unconcerned by the risk assessment to do so. Today's meeting likely won't move those positions much.

Still, the recommendations of the task force will include following the guidelines set forth in the Texas Secretary of State's Election Advisory #2006-16, along with the 'best practices' suggestions of Travis County clerk Dana DeBeauvoir in her "Method for Developing Security Procedures in a DRE Environment" (.pdf) which include logic and accuracy tests, parallel and hash code testing and post-election and audit protocols to prevent -- or failing that, detect -- electronic vote tampering.

That's not too much to ask, is it?

Texas SOS, Harris registrar fall behind in processing voter registrations

But I'm sure there will be plenty of provisional ballots available:

Thousands of Texans who registered to vote a few weeks ago likely will find their names missing from official voter lists when early voting starts Monday for the Nov. 4 election, officials said.

The voters will be allowed to cast ballots but may have to fill out special forms at polling stations or wait a few days before voting, according to state and Houston-area election administrators.

Officials blame a deadline-beating rush of registration applications before Oct. 6, and maintenance to a computer database of Social Security numbers, for the fact that many registrations won't be processed in time for the early voting kickoff.


But praise be, tax assessor-collector/voter registrar Paul Bettencourt indicates that only 7000 Houston-area voters may be affected:


In Houston, about 70 employees in the voter registrar's office will work through the weekend to clear most of a backlog of about 30,000 applications, Tax Assessor-Collector Paul Bettencourt said Friday. Some will turn out to be valid, others duplicates or address changes for voters on the rolls.

But, he said, perhaps 7,000 applications from Harris County residents will require extra verification and probably won't be cleared before Monday, the first of 12 days of early voting at 36 county locations.

The Secretary of State's Office in Austin must also verify the applications, using driver's license and partial Social Security numbers, before voters are added to lists in each county of qualified voters. But as the state agency works through the weekend to handle applications submitted by counties, it will take about 24 hours to approve each new voter.

"We were keeping up very well with the increased load, but we started to run a little behind when the Social Security Administration closed their (computer program) down for maintenance last weekend," said Ashley Burton, spokeswoman for Secretary of State Hope Andrade. "Since the start of October there has been a huge increase in the number of new voter records that the counties have submitted for verification."

No information was available on the database outage, a Social Security spokeswoman in Dallas said Friday. Nor were statistics available from the state on what Burton called applications from "large amounts of new voters" outside Harris County.


So as the conservatives continue to drive themselves nuts over ACORN, the voter suppression efforts contine to be the real story locally. Bettencourt says that ten thousand people missed the deadline to vote in this election (note also the statistics I bolded below for future reference):


Many Harris County residents may not realize, until they try to vote, that their registrations were submitted or mailed too late for the Oct. 6 deadline.

About 10,000 such registrations will be added to the rolls for future elections, Bettencourt said, but those voters will be unqualified to vote in the Nov. 4 election for president, Congress, county officers and other government positions.

About 1.94 million voters will be eligible to cast ballots this year in Harris County, roughly the same number for the last presidential election. The statewide voter roll has edged up to 13.4 million, about 300,000 more than last time.

The Harris County election administrator, County Clerk Beverly Kaufman, said 300 or so staffers at early voting locations are prepared to assist residents who want to vote even though they may be missing from registration records.

For voters who present a voter registration card or other identification — no photo ID is needed — but whose name is absent from the voter rolls, election workers first will call Bettencourt's office to see if their registrations have been approved, Kaufman said. In many cases, voters will immediately be cleared to vote.

Voters whose names are not on the lists may also vote immediately after swearing, in a written provisional ballot form, that they registered. But their votes will be separated from the main ballot record, Kaufman said, and will be counted after Nov. 4, if their registration is verified.


Or perhaps they won't be counted at all. Seriously.

I'm going to do a little shouting now.

If your name does not appear on the voter roll when you go to vote, PLEASE DO NOT FILL OUT A PROVISIONAL BALLOT. Leave the polling place and call this number: 1-866-OUR VOTE (687-8683).

This is also why you should vote early; so that if there are "issues" with your registration, they can be cleared up -- hopefully -- in time for you to cast a ballot that counts (with at least as much faith as we are able to place in electronic voting systems, anyway). You don't want to be experiencing this circumstance at 6:45 p.m. on Election Day.

And remember when you do vote that Bettencourt's Democratic challenger is Dr. Diane Trautman.

500,000 early voters in Harris County

That's more than several states will have for the entire election cycle:

An unprecedented half-million Harris County voters are expected to cast early ballots for the presidential race and other offices during the two-week early voting period, an increase sparked in part by political parties and candidates urging supporters to vote before Election Day.

In response to the forecast of a record-high early vote that starts Monday in Texas, county officials have added extra polling stations and voting booths and new auxiliary equipment to keep waiting lines as short as possible.

Also, Harris County Clerk Beverly Kaufman has published figures on average hourly voter traffic at each polling station in the 2004 presidential election, so citizens can see which centers are likely to have the shortest lines this time. And she plans to conduct daily news briefings about early voting at five locations next week, from Humble to far southwest Houston.


Previously I noted that Kaufman's office projects 1.2 million total votes in the greater Houston area's county will be cast in November's election, and that's a figure that could portend as many as nine million votes in Texas (though I believe the final figure will be closer to eight).

There are several reasons for the anticipated increase in early voting.

The percentage of votes cast early has climbed with every past election, and the trend is expected to continue as voters become more comfortable with the idea of getting voting out of the way before Election Day.

In 2004, almost 40 percent of the Harris County vote was banked by the end of October. The total county vote then was 1.08 million, a 58 percent turnout of all registered voters.

With the participation rate expected to climb along with the use of the early voting options, experts say at least half of the Harris County votes — a half-million or more — will be cast before Nov. 4.


And both parties are gearing up their GOTV efforts ...

The local Republican Party will distribute at least 150,000 "door-hanger" campaign cards in some of its stronghold neighborhoods to get voters to the polls early, chairman Jared Woodfill said.

The Harris County Democratic Party on its Web site urged voters to cast early ballots, explaining: "It allows us to focus on voters who have yet to vote and getting them to the polls."

Some campaign strategists keep meticulous computerized records of voters who have voted early in past elections and will direct some of their limited telephone and mail resources at those voters, Republican consultant Allen Blakemore said.

Many candidates who have been hoarding money for a late deluge of TV, radio and Internet ads will join the onslaught of political messages next week.


The local GOP has also concentrated on sending mail-in ballots to identifiable suburban seniors who reliably vote Republican, and have been bragging that their mail-in ballots will bear significant fruit this time.

... Houston is essentially its own swing state within Texas. Harris County, which encompasses the city and its suburbs, is home to 3.9 million people, outnumbering the populations of 23 states, and is roughly the same population as Oregon. Now consider that Harris County—in theory, at least—is already Democratic. Surveys and polls repeatedly show that more of its eligible voters identify with Democrats. It’s just that many of those people don’t vote. Moreover, the area is growing. Subdivisions are sprouting at the city’s edge like weeds. The people moving in are mostly Democrats. Harris County is undergoing a demographic shift that will soon put Anglos in the minority.

Practically speaking, a Democrat can’t win a statewide race in Texas without carrying Harris County. If the party can increase its turnout just enough in this presidential year to turn Harris County blue, Democrats will control five of the state’s largest counties and could become competitive again in races for governor, lieutenant governor, and U.S. Senate. Democrats are feeling the urgency to capture a statewide race and at least one chamber of the Texas Legislature by 2010 to gain a say in the next round of legislative and congressional redistricting.

But Houston’s size and shifting demographics have local Democrats dreaming well beyond the Governor’s Mansion. They talk of a day when Houston could be for Texas what Philadelphia has been for Pennsylvania—a metro area that votes so overwhelmingly Democratic it provides a large enough advantage to deliver the state almost by itself. (In the 2004 election, Philadelphia handed Democrats a 400,000-vote edge in the state’s largest population center—a margin Republican areas of Pennsylvania couldn’t surmount.)

Harris County Democratic Party Chair Gerry Birnberg points out that if big margins in Houston could help a Democratic presidential candidate capture Texas, the Electoral College map would shift decisively. He says New York and California likely will vote Democratic for a generation. “If you can start a presidential cycle with California, New York and Texas already in your column, there is not an electoral map you can draw that a Republican candidate can win,” Birnberg says. “Harris County is ground zero. We don’t get there without Harris County.”

Late last night (and more musings about election results)

-- Glitches push final tally into early morning hours:

There were a few problems coming up with a final tally on Tuesday’s election because of a political party oversight and mostly technical difficulties, pushing the night’s last count to at least 2 a.m. Wednesday.

After a few early-evening hiccups that led to the first results posting 90 minutes after polls closed Tuesday, midnight-hour issues emerged.

First, the Republican primary in precinct 256 had its results stored on a corrupt card, which meant workers had to pull results from another database or, as a last resort, from each e-Ballot station.

An unidentified Democratic precinct had a faulty machine, creating the need to merge results from more machines than planned to arrive at a final total.

Then around 11 p.m., Harris County Clerk Stan Stanart revealed that 1,500 to 2,000 mail ballots that had arrived since Friday still had not been processed.

As well, there’s the possibility that some of the tightest races may turn when ballots from active-duty service members arrive since they have an additional five days past the election for their votes to show up and be counted. Provisional ballots also take a few days to process.

So, there’s a huge asterisk on the Harris County results at this point early Wednesday.

It’s been a rough night.

Yes, and Stan Stanart is an incompetent fool. As you will recall, I observed this process a handful of times during Beverly Kaufman's tenure. She always had EV results posted within one minute of 7 p.m., and she always had enough ballots counted for the local network affiliates to call all but the closest races by their 10 p.m. newscasts.

Unless Stanart fired all the people who used to work for Kaufman (doubtful), the real evidence here is that the brand-new Harris County Clerk doesn't know how to run an election that ran on autopilot in the years before he was elected.

We could have had Ann Harris Bennett in that slot, who in November will challenge the guy who knocked off incumbent Don Sumners last night. Ignore the ramblings of Gadfly Bettencourt in that link.

-- It was a good night for the slate mailers and Super PACs last night. And a bad one for some of Joe Straus' henchmen (aka the 'moderates' in the Texas House).

(E)lection night results brought bad news for some key Straus lieutenants in the Texas House, including Rep. Rob Eissler, R-the Woodlands, chairman of the House Education Committee. Eissler, who lost to challenger Steve Toth, may have suffered from complacency as his campaign latest finance reports showed an unspent balance of $650,000.

In North Texas, Rep. Vicki Truitt, R-Irving, another Straus chairman, also fell to a tea party challenger, Giovanni Capriglione. And in East Texas, Rep. Mike “Tuffy” Hamilton, another Straus ally paired in a redrawn district with an incumbent, lost to Rep. James White.

All the defeated incumbents were targeted by Empower Texans, a conservative group which spent close to $120,000 trying to defeat Straus by portraying him as too moderate to lead the Texas House. Financed by Midland oilman Tim Dunn, the group was behind the 2011 effort to oust Straus from the Speaker’s office.

There will be more Mucus involved in the Speaker's race in the run-up to January 2013 and the opening day of the Texas Lege, but my early guess is that the Democrats provide Straus enough cover to get re-elected.

-- Ted Cruz wants five debates with David Dewhurst between now and the runoff on July 31. And Paul Sadler wants in on them, too.

First of all, nobody wants to be tortured with a debate every two weeks between these two conservatives. Not even the most hardcore TeaBagger could stand it.

Secondly, Sadler himself only got 35% of the vote in a 4-way race, so his runoff opponent Grady Yarbrough should be included if Sadler gets in. That by itself is a travesty, as the Austin Statesman notes...

Yarbrough is a perennial candidate who has run as a Democrat and a Republican in previous elections.

Yarbrough has barely any online presence, yet he ran second in the Democratic statewide primary for the US Senate. Apparently the Mensas who voted for him thought he was Ralph.

And unless this a one-party red state like Communist China, the debates should include the Green, David Collins, and the Libertarians -- all six of them. (Unless you want to hold off on the debates until they elect one of the six at their state convention, the second week of June.)

-- Lissa Squiers led wire-to-wire, finishing with 40% of the Democratic vote in CD-07. James Cargas trailed with 34, and Phillip Andrews had 24.

The absolute best results of the evening, IMHO.

-- Highs and lows locally: Lane Lewis prevailed but Steven Kirkland did not. Two bright spots in Texas House races: Lon Burnham won, Leo Berman lost.

-- I'm not going to give a damn so hard about the DA race in Harris County it will be profound.

-- These Twitter compilations must stop. If I want to read a Twitter feed, I'll go to Twitter.

Adjusting the Vote

I was too ill to perform my duty as the Democratic observer at the Harris County central counting office last week, so at the last minute I asked John Behrman to stand in for me. And look what he saw:


The county Web site already showed that all precinct totals had been counted; three sheriff's deputies who guarded the counting process on the fourth floor of the County Administration Building in downtown Houston had been sent home.

Also in the locked, glass-walled room were Republican (Harris County Clerk Beverley) Kaufman and John R. Behrman, a computer expert and longtime election observer representing the Democratic Party. He said he considers Kaufman's staff the most knowledgeable election computer administrators on the continent and does not question their motives.

But Behrman said he was shocked when he saw (county elections administrator Johnnie) German use a series of passwords and an "encryption key" — a series of numbers on a nail file-size computer memory storage device — to reach a computer program that said "Adjustment."

"A hundred percent of precincts reporting, and everything had been distributed to the press," he said. "Then and only then did I see how they were going to do this, and frankly I never thought it was possible.

"Basically it turns out, without regard to any ballots that have been cast, you can enter arbitrary numbers in there and report them out in such a way that, unless you go back to these giant (computer) logs and interpret the logs, you wouldn't know it has been done."


Hart InterCivic has converted nearly the entire state of Texas to e-Slates. What do you think the security of your ballot might be in a rural county -- where there ain't too many folks who know much 'bout computers?

But the real value is in the largest counties in the state, where manipulating the tally -- say, in an $800 million bond election -- has a chance for a real payoff. For a few insiders.

Who needs to hack the vote when you can just bribe a county elections official?

Why do you think several states have decertified Hart InterCivic's e-Slates for use?

And it's easy to understand the nonchalance of Republican officials and Republican-appointed judges, but why do you suppose it is that Houston's Democrat mayor (and rumored candidate for governor in 2010) , Bill White, doesn't really care about this problem?

So, indeed, Hart has multiple lines of defense. Unfortunately, every one of them is incorrectly engineered, rendering the system entirely vulnerable to compromise. Of course, I am not stating that any such compromise has ever happened in Harris County. What I am saying is that the design of the Hart system is entirely insufficient to prevent such attacks, should a competent attacker wish to make them.

An elections administration department in Harris County?

Liz Peterson has a good update here on the continuing saga of difficult democracy at the ballot box in the nation's third-largest county:

The departure of Tax Assessor-Collector Paul Bettencourt has opened the door for some discussion of whether his successor should inherit the job of maintaining Harris County's voter rolls, a duty assigned to that office in the days of Jim Crow poll taxes.

State law allows Commissioners Court to assign that responsibility to the county clerk, who already conducts elections and counts the votes, as long as the county clerk and the tax assessor-collector sign off on the plan. The court also can create an independent elections administration office to handle all election-related duties.

Seventy-three of Texas' 254 counties have established separate elections offices, including every large, urban county but Harris and Travis. Nineteen other counties have assigned the voter registration role to the county clerk.

Earlier this month, Republican precinct chairman Jim Harding proposed moving the rolls to the County Clerk's Office, saying that would "streamline all of the voter activity from initial registration to final certification of an election under county clerk leadership."

Republican County Judge Ed Emmett and Democratic Commissioners Sylvia Garcia and El Franco Lee have said the idea of moving the rolls is worth discussing, though little consensus has emerged over how that should be done.

Emmett said he would be open to shifting those duties to the county clerk but opposed the creation of a new elections administration office. Garcia said she prefers the idea of an elections administrator because that person would be prohibited by law from making political contributions or endorsing candidates or ballot measures. Lee said he is not sure either change would do enough to make the voter registration process more transparent and user-friendly.


So Commissioner Garcia -- who abandoned her support of Diane Trautman for tax assessor/collector and voted for Leo Vasquez last week -- and Commissioner Lee are for the idea; Judge Emmett is lukewarm, and most of the rest of the parties involved are against it: Clerk Kaufman, TA/C Vasquez, and Commissioner Radack ...

For her part, Republican County Clerk Beverly Kaufman said she is not interested in adding voter registration to her many responsibilities. And newly appointed Tax Assessor-Collector Leo Vasquez said he believes the current system is very efficient.

"Why create yet another organization, another layer of bureaucracy in Harris County government?" Vasquez said of the elections administrator idea. "It just doesn't make sense."

The idea could also face significant opposition from Republican Commissioner Steve Radack, who said he would not vote for an elections administrator under any circumstance. He said the the current system offers checks and balances while allowing voters to judge whether the tax assessor-collector and the county clerk are doing a good job.

"I think that's good and healthy for the electoral process," he said.

An elections administrator would be appointed by a county elections commission composed of the county judge, the tax assessor-collector, the county clerk and the chairmen of both political parties.

Firing the administrator would take a four-fifths vote of the county elections commission and a majority vote of Commissioners Court.


Oh yeah, there's Federal-Indictment-Any-Day-Now Eversole:


Republican Commissioner Jerry Eversole declined to comment, saying he would make his opinion known if the topic came up during a court meeting.


Don't expect to see anything come of this entirely worthwhile proposal.

Good, Bad, and Ugly: more of each

-- The Good: disappointing turnout on Election Day notwithstanding, Harris County voting proceeded with only the most minor of hiccups. Beverly Kaufman added extra polling locations, made technical improvements such as barcode and driver's license scanning that shortened wait times and reduced data-entry error during EV, secured the transfer cases (cardboard boxes) of e-Slates with an improved seal, added two extra seals on the e-Slates themselves that restricted election judges from setting up and activating the ballot boxes until the morning of Election Day, and took other precautions that John Behrman and others have urged, from parallel testing to quarantining of suspect machines. Berhman also was granted additional access to areas and information that were previously deemed ministerial and confidential.

I'm usually the critic, so when a compliment is due I don't want to run a deficit. Good job, Ms. Kaufman and the same to all of your staff, including elections supervisors John German and Randy Roberts and the platoons of assistant clerks.

-- The Bad: Hispanic precincts turned out their vote at 40-45% -- outstanding in any other election year, but lame compared to the countywide average of between 60-65%. No one seems to have a good answer beyond latent racism, lingering disillusionment at Hillary Clinton's primary loss, or lack of GOTV efforts in that community:

Local Democratic Chairman Gerald Birnberg said his party struggled to get former supporters of Hillary Rodham Clinton's presidential primary candidacy to return to the polls and vote for Obama and the rest of the party's slate. Clinton was immensely popular among Hispanic voters in Texas.

"The head wind was the demoralization of many of the Hispanic Hillary Clinton supporters and that was a reality we faced throughout the election," Birnberg said.

As Democratic political consultant Marc Campos of Houston pointed out, Tuesday's election totals put turnout in mostly Hispanic state House districts at 40 to 45 percent, compared to 60 to 65 percent in mostly white, suburban districts as well as mostly black districts.

Campos, a Hispanic, said his party's efforts to motivate Hispanic voters was substandard. Birnberg disagreed, saying that among other things, Democrats aimed at Hispanic households with a recorded telephone message from Clinton urging voters to back every candidate.

Birnberg pointed out that all countywide Democratic Hispanic candidates won their contests except one, while district attorney candidate C.O. "Brad" Bradford and other black candidates lost.

Regardless, "clearly we must continue to do better year in and year out in the Hispanic community," Birnberg added.


Bob Stein offers another clue, which goes to Paul Bettencourt's strenuous efforts to clerically suppress the vote:

About 100,000 people who voted in the spring Democratic primary failed to vote in the county's general election, according to Rice University political scientist Bob Stein.

"I don't think they're disinterested in politics. I think it's the way we conduct our elections and how we make it very difficult for people who move around a lot to re-register," he said.

Republican Paul Bettencourt, the voter registrar re-elected as county tax assessor-collector, rejected Stein's theory.

About 100,000 other people easily updated their registrations for the general election, he said. Also, he theorized that turnout would have been much higher if Obama or John McCain or their running mates would have campaigned in Houston.

I'll be damned; Bettencourt is right. Obama not only never came back to Texas beyond a fundraiser, he sucked hundred of volunteers out of the state to work in New Mexico and other swingers, and many who couldn't leave spent their weekends calling battlegrounds on Obama's behalf.

I fault the Texas Democratic Party for allowing this to happen. This is where it gets ...

-- Ugly:

(T)he Obama campaign gobbled up the potential volunteer base for a statewide sweep campaign by exhorting Texans to campaign in other states, both physically and over phone banks. But I don't blame the Obama campaign. At least they had something for the vast Texas Democratic volunteer base to do. How can we blame the Obama campaign for making use of this huge volunteer base when the Texas Democratic party did not intend to make use of it?

Can anybody identify a single specific action or statement from the State Party demonstrating that it seriously wanted Obama to put Texas in play?


MoveOn wore me out asking me to work for Obama. Meanwhile I was busy working my precinct for all Democrats. And the TDP apparently sent a mailer to GOTV, which I'm told they spent hundreds of thousands on to send all over the state.

Ah, so the Democratic political advisors specializing in direct mail got remunerated handsomely.

So long as we Texas Democrats continue to listen to the self-inflated consultants and other "pundits" who insist on running targeted campaigns instead of sweep campaigns, we cannot expect a sweep-campaign outcome!

The longest ballot in history?

That's what they keep saying.

If it seems like that Harris County ballot you got in the mail is long, it is. Veteran election watchers say it is the longest they can recall.  The ballot is so long that it requires 61 cents to mail in your vote. Harris County Democratic Party Chairman Gerry Birnberg joked, "We're real close to a poll tax here."

Harris County Clerk Beverly Kaufman recently gave a vivid demonstration of the daunting list voters face Nov. 2 by unfolding a ballot that extended to nearly her height.

Voters are "overwhelmed," said the Houston-area League of Women Voters president, Nancy Parra. The League's executive director, Christina Gorczynski, said the office never has received so many calls. A fire that destroyed nearly all of the county's voting machines has people clamoring for information about how to vote early, she said.

Keep in mind that if you vote early (EV starts next Monday the 18th and runs through Oct. 29), you can only vote electronically on a borrowed e-Slate. If you vote on Election Day you can ask for a paper ballot.

For the first time in several elections, I'll be voting on Election Day.

University of Houston political science professor Richard Murray said this year's ballot is the longest he has seen in the 44 years he has lived in Harris County and speculates that it may be the longest one in the nation this year.

"It's almost certain it's the longest ballot in the history in the state because we're by far the biggest county," Murray said.

No Harris County voter has all 252 candidates and 142 election contests on his individual ballot, but every one starts with 72 judicial contests.

Harris County Republican Party Chairman Jared Woodfill said the party's response to the lengthy ballot is simply to promote straight-ticket voting. Woodfill said the phone calls, door hangers, radio spots and mailers all will emphasize voting for all Republicans with one sweeping vote. In the 2008 presidential elections, 62 percent of Harris County voters cast straight-ticket ballots.

LOL, Jared. Democrats out-voted the GOP in straight ticket votes in both 2006 and 2008, and I don't believe the Tea Party likes some of the Republicans on your ballot. Besides that there are many, many Republicans splitting their ticket starting with the governor's race.

Kaufman notes that the Libertarian Party has fielded dozens of candidates in congressional and state races, lengthening the ballot by a few names on any individual ballot.

The Libertarians will suck away a minimum of 5% of the usual GOP tally, probably more like 7 or 8.  It's really a shame Kathie Glass isn't drawing off more of Goodhair's base; she's plenty kooky enough for the Teas and the Medinaites and even some of the Kay Bailey primary voters. We already know that a lot of moderate GOP are breaking for White.

The Greens also have a handful of candidates, mostly at the statewide level. Again, because the Dems did not field a Comptroller candidate, Edward Lindsay carries the torch for future Green Party ballot access in Texas. As Neil notes, if he gets 5%, they'll qualify in 2012.

The League of Women Voters has help for voters. To get voter guides and a ballot for your precinct, visit www. onyourballot.vote411.org. The League's paper voter guides should be in local public libraries by Wednesday. The county clerk's website, www.harrisvotes.net, has information on early voting locations, how to obtain a mail-in ballot and which races are on individual ballots. 

The League and Murray advise voters to do their homework and write down whom they intend to vote for before they enter the voting booth.

Straight-ticket voting does assure that bottom-of-the-ballot candidates get their share (many voters who split their ticket get tired of the long ballot and stop before they get to the end). But because there are frequently issues with straight-ticket voting at the top of the ticket -- and with Harris County using e-Slates from many other places, the likelihood of voting on a compromised one is increased -- the League's and Dr. Murray's advice is well-taken. The best advice to ensure your votes count as you intend is to study a sample ballot in advance, read the ballot and voting instructions provided to you at the polling place carefully before casting your vote(s), and ask a poll worker for assistance if you are unsure about any aspect of the voting procedures. If you think you may have spoiled your ballot, do not hesitate to report the situation to a poll worker.

Another thing to keep in mind is that some political parties may not field candidates for every single partisan office on a ballot, so by selecting a straight ticket you may end up not voting at all in some races. Therefore, if you plan to vote a straight ticket, you might want to review your ballot first to verify that your party has a candidate running for every partisan office listed (and also be sure to cast votes for non-partisan offices not included in the straight ticket selection process). As they say, "If you're going to take the time to vote, take a few extra seconds and make every vote count."

Fixing the vote (and then fixing that)

If you can watch this entire video and still use an electronic voting machine, you deserve the government you get. If your state or district has decided to use electronic voting machines this November demand an absentee ballot today. Watch this video. Then join those of us who have decided that since paper was good enough for our Constitution, it's good enough for our vote too.
Oh, and when you're done watching the whole video... pass it along. November is only a few weeks off and the last thing Republicans want to see is either house returned to Democratic control. Because if that happens, hearings happen. And if hearings happen... well, who knows - someone(s) could go to jail. So demand a paper ballot or an absentee ballot in Nov. and leave the cheaters with a pocket full of worthless Diebold electrons.

It would rig an election?

It would flip the vote, 51-49. Whoever you wanted it to go to and whichever race you wanted to win.

And would that program that you designed, be something that elections officials... could detect?

They'd never see it.


Two recent Houston Chronicle editorials detailed the concerns of fraudulent vote processing associated with Hart Intercivic's e-Slates, the DRE voting machines in use in Harris County and throughout the state. First, Stan Merriman wrote:

When the Hart voting systems were acquired in 2001, voters in Harris County thought they were being treated to the "latest and greatest" in voting system technology. This electronic system replaced a punch card system (remember hanging chads?) with the belief that we needed to enter the electronic age in the electoral process while also meeting emerging federal guidelines to simplify the voting process for our disabled citizens. ...

In the 2002 election some strange "vote flipping" incidents occurred that actually resulted in the temporary sequestering of machines reported as malfunctioning. The problem occurred with votes cast for senatorial candidates Ron Kirk and John Cornyn "flipping" to both rival party candidates. Lawyers were dispatched to scratch their heads over the cause and effect. No resolution of the situation was achieved.

This same anomaly occurred in the Kerry/Bush presidential election in 2004 in Harris County. Once again, the matter was dismissed as a "glitch" of no consequence and blamed on improper voter use. ...

In all, 1,218 voting machine complaints were filed in Texas in the 2004 general election with People For The American Way's Election Protection Division. In Harris County, 2,400 voting machine complaints were filed with a national voting advocacy group during that election.

In addition to these complaints, others were filed in Collin, Travis, Bexar and Wichita counties. Complaints included vote "transfers" (Kerry/Bush evidenced the same phenomenon reported in the 2002 and 2004 election in Harris County), lost votes, and machine and memory card failures. For the 2004 election, the Electronic Frontier Foundation and the Verified Voting Foundation received more complaints from Harris County than from any other voting jurisdiction in the nation.


And the Chronicle editorial board wrote:


"If folks can hack the Pentagon," Harris County Democratic Chairman Gerry Birnberg said, "they can certainly hack a machine in Harris County."

County Clerk Beverly Kaufman, a Republican, says such concerns are unfounded. "There's this kind of cavalier attitude on these folks' part that all you've got to do is just bolt on a printer and there it is," said Kaufman, who estimates that it would cost up to $8 million to buy equipment and reprogram the system with the capability to print ballots in three languages. "We're just not at a point here where we're able to do it if we wanted to, which we don't."


Well, we're just going to have to fix this, Bev. And we're going to do so first by replacing you with someone who does.

Stanart chokes again

As of 9:15 p.m.(Election Night), Harris County still had not posted any voting data from Election Day on its website; only early voting data was available.

Harris County Clerk Stan Stanart said the delay appears to be due to technical problems in relaying the data via phone lines from Reliant Park, the drop-off location for all Election Day data, and the clerk’s election hub in downtown Houston.

“It’s a connectivity issue between here and Reliant,” Stanart said. “We’re trying different phone lines. Apparently Reliant gave us some garbage phone lines out there. That’s what it looks like right now.”

Stanart said, at this point, he’s not sure of the specific problem or who in particular is to blame. ...

Reliant never gave anyone garbage phone lines when Beverly Kaufman was the county clerk. Besides, I thought AT&T was in the phone line business, not Reliant. The morning -- or maybe afternoon -- after...

Stanart blamed delays in posting results on a Reliant Park contractor, saying his office had been given "garbage" phone lines over which to securely transfer voting data downtown.
He said the equipment had been tested, but the Reliant phone lines had not because they were not activated until Tuesday.

Reliant's phone line contractor got it wrong, then. At least that's not as cheesy as blaming the Democrats, as Stanart did in May after the primary election. 'Garbage phone lines', however, doesn't resolve the confusion in the Precinct 2 contest.

The discovery of an error in which some votes were counted twice appears to have changed the result of the Harris County Precinct 2 constable’s race.

County Clerk Stan Stanart said this afternoon he will know more detail about what happened, but said an updated report that went online at 10:12 p.m. displayed incorrect vote tallies for Democratic candidates. One batch of precinct data appears to have been counted twice, he said, while stressing that the final tallies posted at 12:43 a.m. are correct. 

So now we have computers tabulating votes that can count them twice. And the King Street Patriots are worried that Mickey Mouse or the Dallas Cowboys might try to vote.

“When we merged the databases there was an error that was not caught by my people and was not caught by the election judge. We ended up with a double count of one of the databases,” Stanart said, adding he has met with (Precinct 2 Constable candidate Zerick) Guinn and assured him they’ll have a meeting to go over the situation in more detail.

Guinn said Stanart had no answer when he asked why the number of total votes in the race appeared to drop by 478 between 10:12 p.m. and 12:43 a.m. while his person vote total dropped by 634 votes.

Stanart said he saw problems in a not-yet-published report of GOP results shortly before midnight, and began running both parties' results from scratch. Stanart said he initially thought the problem was isolated to the report he had just run on the computer he was using, and, thus, did not pull the faulty numbers off the county website and did not inform Democrats because their numbers were being generated by a different computer.

By late Wednesday, Stanart said, he had learned both parties' results online from 10:12 p.m. until at least 12:43 a.m., were wrong, though he stressed only the outcome of Guinn's race had changed.

Do you believe him?

"The Republican Party keeps screaming about voter fraud, but it seems the mistakes, year after year, are happening in the tax assessor's office and the county clerk's office," (HCDP chair Lane) Lewis said.

Stanart and tax assessor Don Sumners, whose office botched the boundaries for the department of education primary, are Republicans. Sumners maintains the department was required to notify him of the boundary changes; the department disagrees.

Stanart said voters should have faith in his office, adding he is going to develop software to verify that the numbers coming from the counting machine and the reporting machine match.

"Election night reporting is just a small portion of the process that goes into ensuring the integrity of the final count," Stanart said. "I understand the importance of having an accurate count for the public. This will never happen again."
